Welcome to OpenGigs. These Terms & Conditions govern your use of the OpenGigs website and services.
By creating an account, accessing, or using OpenGigs, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our platform.
To use OpenGigs you must:
OpenGigs reserves the right to refuse or terminate accounts that do not meet these requirements.
Users are responsible for maintaining the security of their account credentials and for all activity that occurs under their account.
You agree to keep your account information accurate and up to date.
If you believe your account has been compromised, you should notify OpenGigs immediately.
Artists using OpenGigs agree to:
Repeated no-shows, fraudulent activity, or behaviour that negatively impacts the OpenGigs community may result in account suspension or permanent removal.
Venues using OpenGigs agree to:
Repeated cancellations, fraudulent listings, abusive behaviour, or misuse of the platform may result in account suspension or permanent removal.
OpenGigs provides a platform that connects artists and venues. A booking is considered confirmed once both parties have accepted the engagement through the OpenGigs platform.
Artists and venues are responsible for communicating any additional performance details, contracts, schedules, payment arrangements, and special requirements directly with one another.
OpenGigs is not responsible for disputes arising from agreements made between artists and venues.
During the Early Access period, OpenGigs does not process payments between artists and venues. All payment arrangements are made directly between the parties.
OpenGigs is not responsible for payment disputes, invoices, taxes, refunds, or collection of outstanding balances between artists and venues.
As OpenGigs evolves, integrated payment processing and booking fees may be introduced. Users will be notified of any changes before they take effect.
Creating an OpenGigs account is free during Early Access.
After the Early Access period, OpenGigs plans to introduce optional subscription plans for artists and venues. Certain plans may include booking fees or additional premium features.
The first 100 Artists and first 30 Venues to qualify will receive Founder Member status.
Founder Members receive:
OpenGigs reserves the right to modify or discontinue the Founder Member program for future users. Users who have already qualified as Founder Members will retain their earned benefits.
Only artists and venues who have completed a booking through OpenGigs may leave a review.
Reviews must be honest, respectful, and based on genuine experiences.
Reviews cannot be edited once submitted.
OpenGigs reserves the right to remove reviews that violate these Terms, our Community Guidelines, or that are determined to be fraudulent, abusive, misleading, or otherwise inappropriate.
OpenGigs reserves the right to suspend, restrict, or permanently terminate any account that violates these Terms & Conditions, our Community Guidelines, or applicable laws.
Reasons for suspension or termination may include, but are not limited to:
The OpenGigs name, logo, branding, website design, software, graphics, text, and other content are the property of OpenGigs and are protected by applicable intellectual property laws.
Users retain ownership of the content they upload, including profile information, photos, and media, but grant OpenGigs permission to display that content as necessary to operate the platform.
OpenGigs provides a platform that connects artists and venues. OpenGigs is not a party to agreements made between users and is not responsible for disputes, cancellations, payment issues, performance quality, damages, injuries, or losses arising from bookings arranged through the platform.
To the fullest extent permitted by law, OpenGigs disclaims all warranties, whether express or implied, regarding the availability, reliability, or suitability of the platform.
OpenGigs may update these Terms & Conditions from time to time as new features and services are introduced. Continued use of the platform after changes become effective constitutes acceptance of the revised Terms.
These Terms & Conditions are governed by the laws of the Province of Ontario and the applicable federal laws of Canada.
Any disputes relating to the use of OpenGigs shall be subject to the jurisdiction of the courts of Ontario, Canada.
